Art. 1 – Scope of Application**
1.1. These general terms and conditions of sale (hereinafter referred to as the “GTC”) govern the relationship between the company **TIRABASSO SERAFINO Srl**, with registered office at Via Ada Natali 2 – 63834 Massa Fermana (FM), REA FM-116432, VAT/Tax Code 01151370440, certified email [clienti@pec.tirabasso.com](mailto:clienti@pec.tirabasso.com) (hereinafter “TIRABASSO”), and any individual making online purchases through the website shop.tirabasso.com (hereinafter the “Website”).
1.2. These GTC may be amended at any time, and such amendments shall become effective upon publication on the Website under the "General Terms and Conditions of Sale" section. Users are therefore invited to read them carefully before making any purchase.
1.3. These GTC do not govern the sale of products by third parties who may be present on the Website via banners, links, or other hyperlinks. Before purchasing products from these parties, users must consult their respective terms and conditions.
1.4. A copy of these GTC can be downloaded and stored by the Customer via the link included in the order confirmation email, pursuant to Article 3.

**Art. 2 – Definitions**
2.1 For the purposes of these GTC, the following definitions shall apply:
* “User”: any visitor to the Website who interacts with its features.
* “Consumer”: as per Art. 4, paragraph 1, letter a) of the Consumer Code, any natural person acting for purposes unrelated to their business, commercial, craft, or professional activity.
* “Customer”: any person (whether a Consumer or not) who accesses the website tirabassoserafino.it, uses its services, and places orders for products sold by TIRABASSO.
* “Contract”: any agreement between TIRABASSO and a Customer regarding the purchase of one or more products, concluded in accordance with the procedure outlined in Article 3.
* “Order”: any purchase proposal made by the Customer to TIRABASSO for one or more products, in accordance with Article 3.

**Art. 3 – Purchase Contract Conclusion Procedure**
3.1. Product purchases on the Website require prior registration (see Article 4) and are permitted to both Consumers and non-Consumers. Purchases by natural persons are allowed only if the individual is at least eighteen (18) years old.
3.2. Customers may select one or more items and place them in a virtual “cart,” which can be reviewed at any time before submitting the order. By clicking the cart icon, the Customer initiates the order submission process. Before finalizing the order, the Customer may review and correct their data by clicking "View Cart." At all stages of the ordering process, the Customer will have access to information regarding product features, pricing (inclusive of taxes), accepted payment methods, and shipping terms. Clicking “Proceed to Checkout” submits the order to TIRABASSO and constitutes an obligation to pay.
By placing the order, the Customer fully accepts and agrees to comply with these GTC.
3.3. The product listings on the Website do not constitute a public offer pursuant to Art. 1336 of the Italian Civil Code, but are rather an invitation to submit purchase proposals. Therefore, TIRABASSO reserves the right to accept or reject the Order after verifying data accuracy, product availability, and the Customer’s creditworthiness. In case of rejection, TIRABASSO will inform the Customer promptly, specifying the reason. No claim or compensation can be made by the Customer in this regard.
3.4. The purchase contract is considered concluded when TIRABASSO sends the Customer an order confirmation email including Customer details, order number, total amount, shipping costs, delivery address, and a link to these GTC.
3.5. Upon order confirmation and contract conclusion, the Customer fully accepts and agrees to these GTC.
3.6. Pursuant to Art. 12 of Legislative Decree 70/2003, TIRABASSO informs the Customer that each order is stored digitally via the systems of its service providers, with whom contracts are in place (e.g., server farms).
**Art. 4 – Website Registration**
4.1. The website registration process requires the completion of an electronic form, in which the Customer must enter their personal information and email address. This data will be processed in accordance with current data protection laws.
4.2. Once registered, the User will have a personal account accessible via a username and password. It is the Customer’s responsibility not to share their login credentials with third parties.
4.3. The User agrees to follow the instructions provided on the Website and to enter accurate and truthful personal information, holding TIRABASSO harmless and indemnifying it from any damage, compensation obligation and/or penalty arising from or in any way connected to the User’s breach of the website registration rules or the improper management of their credentials.
4.4. The User is responsible for any irregular actions or behaviors, in violation of current regulations or these General Terms and Conditions of Sale (GTC), carried out by anyone using their personal account. The User must promptly report any theft, loss, or unauthorized use of their password or account to TIRABASSO.

**Art. 5 – Product Availability**
Product availability refers to real-time stock levels at the time the order is placed. However, this availability is purely indicative, as multiple Users may be purchasing the same product simultaneously, leading to potential stockouts before order confirmation.
Even after receiving the order confirmation email from TIRABASSO, partial or total unavailability of the merchandise may occur. In such cases, the Customer will be promptly notified via email about the order cancellation and the terms and timing of any refund.

**Art. 6 – Prices**
6.1. The prices of products are clearly indicated on the Website and are visible both on the representative image of the item (on the homepage or in the product category overview) and in the detailed product page. All prices are expressed in euros.
6.2. The prices shown for each product remain valid until updated online. The Seller reserves the right to modify prices at any time, updating both the item’s image and the related product sheet. The price visible while browsing is the applicable one.
6.3. Product prices are for individual items and include VAT and taxes, but not shipping costs, which are calculated separately. Shipping costs are shown in the cart after the product is added.
6.4. All delivery terms, times, and costs are visible to the User in the cart page before completing the purchase.

**Art. 7 – Payment Methods**
7.1. Purchases on shop.tirabasso.com are secure and guaranteed. Payment can be made using one of the following methods:
* Advance Bank Transfer
* PayPal
* Cash on Delivery
* Credit Card
7.2. In the case of advance bank transfer, the order will be processed only after the full amount has been credited.
Payment must be made within 3 days from the order date. The Customer must include the order number, date, and their full name in the transfer description.
After this deadline, the order will be automatically canceled. Product availability will be assessed upon receipt of payment. Transfers must be made to:

Bank processing times depend entirely on the banking system. Once a transaction is canceled, TIRABASSO cannot be held responsible for any delays or issues caused by the bank.
7.3. If paying via PayPal, the User will be redirected to the PayPal website to complete the payment. Information entered on PayPal will not be shared with TIRABASSO but handled directly by PayPal. In case of order cancellation or non-acceptance, the amount will be refunded to the PayPal account. TIRABASSO is not liable for any delays or damages during this process.
7.4. If choosing Cash on Delivery, the Customer agrees to pay for the product at the time of delivery.

**Art. 8 – Delivery**
8.1. Delivery times vary depending on product availability (e.g., in stock or at the manufacturer) and chosen delivery method.
8.2. Delivery dates are indicative and not binding for TIRABASSO.
8.3. TIRABASSO uses partner couriers/carriers that offer the best price/quality ratio for each destination, ensuring competitive rates and reliable service.
8.4. It is not possible to arrange deliveries by appointment or at specific times/days.
8.5. If delivery fails due to an incorrect address provided by the User, storage at the courier warehouse, or any issue attributable to the Customer, a new shipment will only be made after advance payment of shipping costs.
8.6. Estimated delivery times:
* Italy: 1–3 working days
* Europe: 4–5 working days
* USA: 5–7 working days
8.7. Upon delivery, the User must check:
* that the number of packages matches the shipping document;
* that the packaging is intact and not tampered with, including the sealing tape.
8.8. In case of tampering and/or damage, the User must immediately file a claim by marking “SUBJECT TO INSPECTION FOR...” (specifying the reason) on the delivery document.
8.10. The User must report any damage within 3 days of delivery following the courier’s procedures.

**Art. 10 – Right of Withdrawal for Consumers**
10.1. In accordance with current laws, the Customer qualifying as a Consumer has the right to withdraw from the purchase without penalty and without giving any reason, within 14 days from the date of receipt of the products, pursuant to Articles 52 et seq. of the Consumer Code, as amended by Legislative Decree No. 21 of February 21, 2014.
10.2. To exercise the right of withdrawal, the Customer must notify TIRABASSO within 14 days from delivery (or from the last delivery in the case of multiple shipments), by any explicit statement, such as via email to [info@tirabasso.com](mailto:info@tirabasso.com) or by post to Tirabasso Serafino Srl, Via Ada Natali 2, 63834 Massa Fermana (FM), indicating the Order subject to withdrawal. Upon receipt of such notice, TIRABASSO will confirm via email. The Customer must return the product within 14 days of sending the withdrawal notice.
10.3. If the Customer has exercised the right of withdrawal in accordance with these GTC and returned the product, TIRABASSO will refund the full amount within 14 days from receipt of the withdrawal notice or, if earlier, upon receipt of the returned item. The refund includes all costs incurred, including initial shipping, taxes, and duties. The refund will be processed using the same payment method used by the Customer, unless otherwise expressly requested.
10.4. Product integrity is essential for exercising the right of withdrawal. The Customer will be liable for any decrease in value resulting from handling beyond what is necessary to assess the nature, characteristics, and functioning of the product.
10.5. The right of withdrawal is valid only if the products are returned undamaged and in their original packaging.
10.6. Return shipping costs are borne by the Customer.
10.7. Until delivery to TIRABASSO, the goods remain under the Customer’s responsibility.
10.8. The right of withdrawal also applies to purchases made by Users residing outside the EU under the same conditions outlined above. However, in this case, TIRABASSO will deduct a fixed fee of €45.00 for handling costs from the refund.

**Art. 11 – Forfeiture of Right of Withdrawal**
11.1. The User forfeits the right of withdrawal and corresponding refund if TIRABASSO finds even one of the following conditions:
* Partial use of the product or consumable materials
* Absence of original external or internal packaging
* Missing product components (accessories)
* Product damage not caused by transport
11.2. In such cases, TIRABASSO will return the product to the Customer and charge the shipping costs.

**Art. 12 – Legal Warranty of Conformity for Consumers**
12.1. All products sold on the Website by TIRABASSO to Consumers are covered by the legal warranty of conformity as set forth in Articles 128 et seq. of Legislative Decree No. 206 of 2005 (Consumer Code).
12.2. The warranty is valid if the defect appears within 24 months of delivery and if the Customer notifies TIRABASSO within 2 months of discovering the defect.
12.3. In such cases, the Customer has the right to have the product repaired or replaced free of charge, or, where applicable, to a price reduction or contract termination.

**Art. 13 – Applicable Law and Jurisdiction**
13.1. The purchase contract concluded on the Website is governed by Italian law.
13.2. This is without prejudice to the application of more favorable and mandatory provisions under the law of the country in which the Consumer resides.
13.3. For Consumers, jurisdiction for disputes relating to the GTC lies with the court of their place of residence or domicile. In all other cases, jurisdiction lies exclusively with the Court of Fermo.
13.4. Users residing in EU member states other than Italy may use the European Small Claims Procedure (Regulation EC No. 861/2007), provided the claim does not exceed €2,000, excluding interest, fees, and expenses.
